Producer Responsibility

Someone got to take it and if you are the one placing the product on the market it is you.

How do I know I'm a producer?

If you are the one placing electronics and/or batteries on the EU market you are the producer. If they are shipped with packaging you are also the producer of packaging. 

Answer yes to any of these questions and the producer responsibility is on you:

  • You are established in an EU member state and manufacture batteries/electronics, or products containing batteries/electronics, and sell them under your own name or trademark.
  • You are rebranding someone else's batteries/electronics, or products containing batteries/electronics, and sell them under your own name or trademark.
  • You import batteries/electronics, or products containing batteries/electronics, from outside the EU and are the first to place them on the market.
  • You sell batteries/electronics, or products containing batteries/electronics, on the internet direct to end users in another country.
EU Regulations & Directives

There are three streams you need to manage: electronics, batteries and packaging.

PPWR (Packaging and Packaging Waste Regulation)

What you need to do (per EU member state you sell in):

  • Create your own infrastructure for collection, recycling and waste management of your products OR
  • Join a PRO (Producer Responsibility Organization)
  • Report data on products placed on the market

Authorized Representatives (AR): If your company is not physically based in the country where you are selling, you must typically appoint an Authorized Representative (often a service offered by the PRO) to handle your legal reporting.
